Environmentalists say judge's order not being obeyed

HUNTINGTON, W.Va. Environmentalists are asking a federal judge in West Virginia to clarify his ruling barring mine operators from disposing of waste material in stream beds.

The Ohio Valley Environmental Coalition filed a motion in federal court today that contends that the coal industry and regulatory agencies are not complying with the order issued earlier this year.

According to the environmentalists, the U-S Army Corps of Engineers has refused to tell the mining industry how to apply U-S District Judge Joseph Goodwin's order. As a result, mine operators are being allowed to fill streams with waste.

A spokesman for the Justice Department in Washington, D-C, says the agency has not yet reviewed the filing and cannot comment.
